Frequently Asked Questions

  • Can a vendor accept multiple offers?

Yes. Neither buyer nor seller is legally bound until an unconditional exchange occurs. A vendor can receive and consider multiple offers before signing a contract. In NSW, a property remains on the market until contracts are exchanged and all conditions are met. This means a vendor can negotiate with multiple buyers and accept the most favourable offer. However, once contracts are unconditionally exchanged, both parties are legally committed to the sale. Buyers should act quickly and seek legal advice to secure their purchase.

  • When do I require a contract to be prepared?

Prior to marketing a property. A property cannot be marketed without a contract of sale. Certain rural properties are exempt from this ruling and do not require a contract of sale for marketing. The contract must include essential documents such as a zoning certificate, title details, and any special conditions. Without a contract, agents cannot legally advertise or show the property to potential buyers. Engaging a conveyancer early ensures the contract is prepared correctly, preventing delays once an offer is made.
