In NSW, a property remains on the market until contracts are exchanged and all conditions are met. This means a vendor can negotiate with multiple buyers and accept the most favourable offer. However, once contracts are unconditionally exchanged, both parties are legally committed to the sale. Buyers should act quickly and seek legal advice to secure their purchase.
Prior to marketing a property. A property cannot be marketed without a contract of sale. Certain rural properties are exempt from this ruling and do not require a contract of sale for marketing.
