  • What is a cooling off period?

    A cooling off period is a period in time when the purchaser can withdraw from their purchase for no given reason. The purchaser will not default the contract as such; however, they will forfeit the holding deposit of 0.25% to the vendor. Generally, the cooling off period is used to secure the property prior to finance approval, inspections on the property, and advice on the contract of sale. In NSW, the standard cooling off period is five business days, unless extended or waived by mutual agreement. This period does not apply to auction purchases.

  • Who arranges for the stamp duty exemption for me?

    Your conveyancer. They will have you complete the necessary paperwork and provide ID documents. Prior to settlement they will lodge the exemption form with Revenue NSW. Stamp duty exemptions or concessions may apply to eligible first-home buyers, pensioners, or other qualifying individuals. Your conveyancer can see to it that all documentation is correctly completed and submitted on time to avoid delays.   • Is there a checklist I should do before bidding at auction?

    Yes, we recommend these items:

    • Thoroughly inspect the property
    • Ensure everything is in working order
    • Obtain advice on the contract from your conveyancer 
    • Have pre-inspection reports undertaken 
    • Ensure finances are in place 
    • Have deposit available

    Unlike private sales, there is no cooling-off period at an auction, meaning the purchase is legally binding once the hammer falls. It’s essential to review the contract, confirm settlement terms, and understand your legal obligations before bidding.   • When is stamp duty on a property due?

    Either at settlement or before three months from the date of exchange, whichever applies first. Extensions can apply. If you are purchasing off the plan, different deadlines may apply depending on the contract terms. Late payment can result in penalties, so it’s important to confirm deadlines early. Your conveyancer can calculate the amount due, assist with exemptions if applicable, and check that payment is lodged correctly with Revenue NSW.
